Personal Training Agreement
Terms and Conditions:
The client agrees to pay all amounts in this contract regardless of whether the client uses all the personal training sessions. All payments made towards personal training and/or fitness assessments are based on availability of such services and are not based on actual use.
The client acknowledges that it is his/her responsibility to schedule and attend personal training and assessment sessions during the term of this contract. Unless otherwise provided herein, this contract expires in (3) months (from the date of signing).
The client understands that scheduling personal training and assessment sessions commits Paula Bruckner's time, and agrees to give 24 Hours Notice otherwise the client will be charged for the session as if they had attended. In like manner, should the personal trainer fail to advise the client of his/her need to cancel and not give 24 hours' notice, then the session will be retained for usage at a later date by the client.
The client acknowledges that he/she will be engaging in strenuous, physical exercise while participating in personal training sessions and related workouts. Exercise without consulting a physician could cause serious injury to the client and the client represents that he/she has consulted with a physician about his/her wellbeing and the risks associated with the exercise and in particular, with the strenuous physical exercise associated with this personal training program and hereby waives and releases any and all claims that she may have against Paula Bruckner Coaching LLC, its employees or agents for injury sustained by the client as a result of the physical exercise and activities associated with this personal training program.
Should a client's scheduled payment be returned or rejected (debit, credit, or checking) Paula Bruckner Coaching LLC may assess the client a $25.00 service charge fee.
Should the client become unable to complete the personal training and assessment sessions due to the contracted obligations under this agreement, the client may submit proper documentation concerning his/her change in writing, providing 30 days' notice. By provide the written notice to cancel, the client understands that if this notice is dated less than 30-days prior to the next billing date, additional billing may occur during that 30-day period. The client's account must be current and in good standing, (all past due payments must be fulfilled,) before Paula can process the client's request to cancel. Default of payment on the client's last bill date will void any cancellation request, and additional charges could accumulate.
The client understands that this contract acknowledges that any payments made under this agreement are non-refundable, however Paula does have the ability to transfer sessions to a friend or family member.
Consumers Right to Cancel - the client may cancel this contract without penalty or further obligation if done within three 3 business days for a full refund of moneys spent, less any sessions already used.
The client is advised to review their monthly account statement to ensure personal training debit amounts are correct and accurate (if applicable). Any account issues should be brought to the attention of Paula within 60 days of the questioned transaction otherwise the transaction will be considered to have been properly made.
